1. AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement between you ("you," "your," or "user") and Bright Path Wellness LLC ("Bright Path Wellness," "we," "us," or "our") concerning your access to and use of https://www.brightpathwellness.org/ and any related webpages, content, features, forms, scheduling tools, services, and digital materials made available through the website (collectively, the "Site").

By accessing, browsing, submitting information through, or otherwise using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree with these Terms and Conditions, you must discontinue use of the Site.

These Terms and Conditions apply to your use of the Site. Additional terms, financial policies, consent forms, patient agreements, telehealth agreements, or other policies may apply to specific healthcare services, appointments, programs, or purchases.

2. CHANGES TO THESE TERMS

Bright Path Wellness reserves the right to modify these Terms and Conditions at any time.

When changes are made, we will update the "Last Updated" date at the top of this document.

Your continued use of the Site after revised Terms and Conditions are posted constitutes your acceptance of the revised Terms, to the extent permitted by applicable law.


3. IMPORTANT HEALTHCARE DISCLAIMER

The information provided through the Site is intended for general educational and informational purposes only.

It is not intended to constitute medical advice, psychiatric advice, diagnosis, treatment, or a substitute for professional medical care.

Information provided through the Site should not be used to diagnose or treat a mental health condition or other medical condition.

Your use of the Site, submission of an inquiry, completion of an online form, or communication with Bright Path Wellness through the Site does not by itself establish a provider-patient relationship between you and Bright Path Wellness or any healthcare provider.

A provider-patient relationship is established through the appropriate clinical process and in accordance with applicable laws, professional requirements, and Bright Path Wellness policies.

Do not rely on the Site for emergency medical or psychiatric care.

If you are experiencing a medical or psychiatric emergency or believe you may harm yourself or someone else, seek immediate emergency assistance or go to the nearest emergency department.


4. NO GUARANTEE OF CLINICAL OUTCOMES

Every individual's circumstances and response to treatment are different.

Information, educational materials, testimonials, examples, or statements presented on the Site should not be interpreted as a guarantee of any particular diagnosis, treatment outcome, improvement, or result.

Bright Path Wellness does not guarantee that any particular evaluation, treatment, medication, recommendation, service, or resource will be appropriate for every individual.


5. APPOINTMENTS AND SERVICES

Information displayed on the Site regarding services, availability, insurance, fees, appointment processes, or other offerings may change without notice.

Submitting an appointment request or inquiry does not guarantee an appointment.

An appointment, evaluation, treatment plan, medication management service, or other clinical service is subject to:

Provider availability

Applicable intake requirements

Required forms and documentation

Clinical appropriateness

Professional judgment

Insurance requirements, where applicable

Applicable laws and regulations

An appointment is not considered confirmed until Bright Path Wellness confirms the appointment through its applicable scheduling or communication system.


6. APPOINTMENT SCHEDULING REQUIREMENTS

Bright Path Wellness offers both virtual and in-person appointments.

Scheduling requirements may vary depending on the appointment type.

Virtual Appointments

Virtual appointments must be scheduled at least 24 hours in advance of the requested appointment date and time.

In-Person Appointments

In-person appointments must be scheduled at least 30 days in advance of the requested appointment date.

These scheduling requirements are subject to provider availability and do not guarantee that an appointment will be available.

If no appointment is available within the applicable timeframe, you may need to select another available date.


7. CANCELLATION AND RESCHEDULING POLICY

When you schedule an appointment with Bright Path Wellness, that appointment time is reserved specifically for you.

If you need to cancel or reschedule an appointment, you should notify Bright Path Wellness as soon as possible.

Virtual Appointments

Cancellation or rescheduling requests for virtual appointments should be submitted at least 24 hours before the scheduled appointment time.

In-Person Appointments

Cancellation or rescheduling requests for in-person appointments should be submitted at least 30 days before the scheduled appointment date.

Failure to provide the required notice may result in the loss or forfeiture of applicable prepaid fees or other charges, subject to applicable law and the terms of your insurance plan.


8. $35 COPAYMENT AND PREPAID FEES

A $35 copayment or applicable prepaid appointment fee may be collected before or at the time of an appointment, depending on your insurance coverage, appointment type, and Bright Path Wellness's applicable financial policies.

If you cancel an appointment without providing the required notice, the $35 copayment or applicable prepaid fee may be forfeited and may not be refunded, subject to applicable law and the terms of your insurance plan.

Any cancellation fee, missed-appointment fee, copayment, deductible, coinsurance, or other patient responsibility will be handled in accordance with applicable law, applicable insurance requirements, and Bright Path Wellness's financial policies.

The $35 amount may be subject to change if your insurance benefits, appointment type, or financial responsibility changes.


9. INSURANCE AND FINANCIAL RESPONSIBILITY

Insurance coverage and benefits vary by insurance plan and are not guaranteed by Bright Path Wellness.

You are responsible for understanding your insurance coverage and financial responsibility.

This may include:

Copayments

Deductibles

Coinsurance

Non-covered services

Out-of-network charges

Cancellation or missed-appointment fees, where applicable

Other amounts determined to be your responsibility

Bright Path Wellness may verify insurance information as a courtesy, but verification does not guarantee payment by your insurance carrier.

Your insurance carrier ultimately determines your benefits and coverage.


10. NO EMERGENCY SERVICES THROUGH THE SITE

The Site, website forms, email communications, online scheduling tools, and general contact channels are not intended for emergency psychiatric or medical care.

Bright Path Wellness does not guarantee an immediate response to website submissions, emails, appointment requests, or other non-emergency communications.

Do not use these communication methods to report an emergency.

If you are experiencing an emergency or immediate danger, seek emergency assistance or go to the nearest emergency department.


11. PRIVACY AND HEALTH INFORMATION

Your use of the Site may involve the collection of personal information.

29. NO WAIVER

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.


30. ENTIRE AGREEMENT

These Terms, together with any policies or additional terms expressly incorporated into them, constitute the entire agreement between you and Bright Path Wellness concerning your use of the Site.

These Terms do not replace or modify separate patient consent forms, treatment agreements, telehealth agreements, financial policies, privacy notices, or other agreements that may apply to healthcare services.
